Labour activist and leading member of the Solidarity Trade Union of Myanmar (STUM), Daw Myo Myo Aye, has been ordered by the court to remain under bail conditions for six months in relation to charges under the Law Relating to Restriction and Temporary Detention, according to a statement issued by STUM.
On October 24, the Shwepyithar Township Court handed down a ruling under Section 5(1)(f)(g) of The Prison and Probation Act, requiring Daw Myo Myo Aye to remain under a six-month bail period with two guarantors of 30 lakhs MMK each, during which she must maintain good conduct.
Daw Myo Myo Aye was initially arrested by the military junta at her residence on July 25, and charged under the Law Relating to Prison and Probation Act and Sections 40 and 41 of the Associations Registration Law. She was released from Insein Prison on October 20.
STUM said the court has clarified that the case is still under investigation under Section 6 of the Law Relating to Restriction and Temporary Detention, and cannot be withdrawn at this stage, resulting in the court’s order although authorities announced upon her release that all charges had been dropped under Article 494 of the Criminal Procedure Code.
Additionally, the court is scheduled to deliver its ruling on October 27 regarding the bail application filed under Sections 40 and 41 of the Associations Registration Law.
STUM also submitted a separate petition requesting the withdrawal of charges against nine other members who remain in detention. The court has accepted the petition and is expected to hear the prosecutor’s response on October 27.
